Acceptance of Terms

By accessing or using Catawiz (the "Service"), you agree to be bound by these Terms of Usage and any policies referenced within them. If you do not agree to these terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Eligibility

You must be at least the age of majority in your place of residence (and in any event at least 13 years old) to create an account or use the Service. By using Catawiz, you represent and warrant that you meet these requirements and that you are not barred from receiving the Service under the laws of any applicable jurisdiction.

Accounts and Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration and keep it up to date.
• Maintain the confidentiality of your account credentials and any access tokens associated with your account.
• Be responsible for all activities that occur under your account, whether or not you authorized them.
• Notify us promptly of any unauthorized access or suspected security breach.

We may suspend or terminate your account if any information you provide is inaccurate, outdated, or incomplete, or if we believe your account is being misused.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You will not:

• Violate any applicable law, regulation, or third-party right.
• Upload, post, or transmit any content that is illegal, harmful, infringing, deceptive, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other user accounts, or related systems and networks.
• Interfere with or disrupt the integrity, security, or performance of the Service, including by introducing malware or excessive load.
• Reverse engineer, decompile, or attempt to derive the source code of any part of the Service, except where permitted by law.
• Use the Service to develop, train, or improve any competing product or service without our written permission.
• Scrape, harvest, or otherwise collect data from the Service without our prior written consent.

Subscriptions and Payments

Certain features of Catawiz are offered on a paid subscription basis. By subscribing, you authorize us (or our payment processor) to charge the applicable fees to your chosen payment method on a recurring basis until you cancel.

Subscriptions renew automatically at the end of each billing period at the then-current rate unless you cancel before renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and prior payments are non-refundable except where required by law.

We may change pricing or introduce new fees at any time, with reasonable advance notice. Continued use of paid features after a pricing change takes effect constitutes acceptance of the new pricing.

Intellectual Property

The Service, including all software, design, text, graphics, logos, and trademarks, is owned by Catawiz or its licensors and is protected by intellectual property laws. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. No other rights are granted by implication, estoppel, or otherwise.

User Content

You retain ownership of the content you submit to the Service ("User Content"). By submitting User Content, you grant Catawiz a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as formatting), transmit, and display your User Content solely as needed to operate and improve the Service.

You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any law or infringe any third-party rights. You are solely responsible for your User Content.

Third-Party Services

The Service may contain links to, or integrate with, third-party websites, applications, or services that are not controlled by Catawiz. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by the terms and policies of those third parties.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Catawiz disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, Catawiz and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these terms or the Service will not exceed the greater of the amount you paid to Catawiz in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100).

Termination

You may stop using the Service at any time and may close your account from your account settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these terms, if required by law, or to protect the integrity of the Service. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (such as ownership, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

Account Suspension

User's account will be suspended under the following circumstances:

• If Catwiz is used for malpractice, offensive or mileading content.
• The subscription payment renewal is not done (grace period of 8 days will be provided, post that, the service will be blocked) . Data, pictures and content in the cataogs will be unaccessible for a suspended account.

Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which Catawiz is established, without regard to its conflict-of-law principles. You and Catawiz agree to submit to the exclusive jurisdiction of the competent courts located in that jurisdiction for the resolution of any disputes arising out of or relating to these terms or the Service, except where prohibited by applicable law.

Changes to These Terms

We may update these Terms of Usage from time to time. When we make material changes, we will update the date at the top of this page and notify you through the Service or by email where appropriate. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the Service.
